1. About Magic Day

Magic Day is an AI-powered trip planning assistant designed to help users organize and optimize theme park experiences, including attractions, wait times, schedules, notifications, and itinerary recommendations.

Magic Day may use artificial intelligence, automation, third-party data sources, and predictive systems to generate recommendations and updates.

2. Eligibility

You must be at least 13 years old to use Magic Day.

By using the Service, you represent that:

• You are legally able to enter into these Terms
• The information you provide is accurate
• You will comply with all applicable laws and regulations

3. AI-Generated Recommendations

Magic Day uses artificial intelligence ("AI") systems to generate itinerary suggestions, attraction priorities, ride recommendations, estimated wait times, re-planning suggestions, alerts, and other planning assistance features.

You acknowledge and agree that:

• AI systems are not perfect
• Recommendations may be incomplete, inaccurate, delayed, outdated, or incorrect
• Wait times and park conditions may change rapidly
• Technical issues or third-party data sources may impact recommendations
• Magic Day does not guarantee any specific result, experience, optimization, or outcome

All recommendations and AI-generated outputs are provided for informational and convenience purposes only. You remain solely responsible for your decisions, movements, schedules, purchases, reservations, navigation, and actions while using the Service.

4. No Affiliation With Theme Parks

Magic Day is an independent application. It is not affiliated with, endorsed by, or officially connected to Disney, Universal, SeaWorld, or any other theme park operator unless explicitly stated. All trademarks belong to their respective owners.

5. No Liability

To the maximum extent permitted by law, Magic Day, its owners, developers, affiliates, employees, and partners shall not be liable for:

• Missed reservations, rides, or attractions
• Incorrect wait times or inaccurate recommendations
• Schedule disruptions or park closures
• Losses, damages, injuries, delays, or expenses
• Indirect, incidental, special, or consequential damages

You use the Service entirely at your own risk. Magic Day is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.

6. User Responsibility

You are responsible for:

• Verifying information independently when necessary
• Supervising children and guests in your party
• Complying with park rules and safety instructions
• Ensuring your own safety and judgment

Magic Day should never replace your own decision-making or common sense.

7. Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree not to share accounts improperly, attempt unauthorized access, interfere with the platform, reverse engineer the Service, or abuse APIs, automation, or security systems.

We reserve the right to suspend or terminate accounts that violate these Terms.

8. Privacy

By using Magic Day, you consent to the collection and use of information as described in our Privacy Policy. This may include account information, trip preferences, device information, analytics, location-related information (if enabled), and usage data.

We may use anonymized and aggregated data to improve AI systems and platform functionality.

9. Purchases

Certain features may require in-app purchase. By purchasing, you agree that refunds may be limited according to platform rules and applicable law.

Purchases through the Apple App Store or Google Play are managed by those platforms.

10. Service Availability

Magic Day does not guarantee uninterrupted availability. The Service may experience outages, maintenance, delays, bugs, or third-party integration failures. Features may change, be removed, or be discontinued at any time.

11. Intellectual Property

All content, branding, graphics, UI elements, software, mascots (including Orbi), logos, and features are the property of Magic Day or its licensors. You may not copy, reproduce, distribute, or exploit the Service without permission.

12. Termination

We reserve the right to suspend or terminate access to the Service at any time for Terms violations, abusive behavior, fraud, misuse of the platform, or security concerns.

13. Disclaimer

Magic Day provides planning assistance only. It does not provide travel insurance, official park guidance, legal advice, medical advice, or safety guarantees. Always follow official park rules, signage, and staff instructions.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after updates constitutes acceptance of the revised Terms.
